Isn’t the Law Commission currently reviewing burial and cremation law?
On 17th December 2017, the Law Commission announced that its 13th Programme of Law Reform would consider ‘a modern framework for disposing of the dead’. Further detail was announced in 2022: the review aimed to address outdated laws relating to burial and cremation, consider new legislation covering other methods of disposing the dead, and consider the legal standing of last wishes relating to what happens to a body after death. The Law Commission pages give an overview of stages of a typical law review project, and likely government responses. A public consultation was launched in October 2024, and responses to the consultation document were invited by the deadline date 9th January 2025. A full suite of documents is available here.
